Literature Review on Working Capital Management - Essay Example This review is composed of only those studies which have been published and made available through books, journals, magazines and internet. There is no doubt that working capital management is an indispensible part of everyday financial management of a firm. It is commonly understood that working capital requirement is related with the day to day operations of a firm and if the firm finds shortage of working capital, the firm is likely to face liquidity problem, which in turn affect the credit worthiness and the business as a whole. On the other hand, if the working capital position is too high, it does not sound good. Rather, it is a problem of lack of proper management. In other words, too much of working capital will affect the profitability by unnecessarily blocking funds in the current assets. Therefore, finding a proper balance between shortage and excess working capital is the key element of working capital management. The firm's liquidity and profitability are judged in terms of the working capital position of the firm. Jin Mcmenamin, in his famous book 'Financial Management: An Introduction', remarks that worki ng capital is an important measure of liquidity and volume of working capital determines the risk level. The more the working capital, less is the chance of a firm's bills are not met for payment (Mcmenamin, 1999). There have been evidences on the failure of firms that have faced either shortage or excess working capital. The short term financial decisions have got little interest among academicians in the past. However, with modern scholarly and empirical studies, the literature of working capital has grown much than ever before. M. Grass observes that shortage of working capital and excess of working capital have caused many firms to fail and has affected many firm in meeting their short term obligations (Grass, 1972). L.J. Gitman also is of the same argument that working capital management, especially for small firms is the factor that decides success or failure (Gitman, 1982). However, that does not mean that working capital is the only factor that decides the success of otherwi se of a firm. As mentioned in the above paragraph, working capital should neither be excess nor inadequate. Both these conditions are dangerous to a firm. However, working capital shortage is found to be more devastating and therefore, its occurrence should be avoided at all times. An imbalanced working capital position can be expressed through another dimension. Shortage of working capital endangers the liquidity and excess working capital affects the profitability adversely. Studies have been undertaken to empirically prove the evils of these tow danger situations. K Smith, in his paper remarks that working capital is significant because it directly affects the firm's profitability (Smith, 1980). J. B. Sarkar and Saha S N, in a case study entitled 'Profitability Crisis and Working Capital Management in the Public Sector in India', observe that the profitability of the selected public sector undertakings in India is suffered owing to inefficient working capital management (Sarkar, 1987). In anoth er study by A. K. Mukherjee entitled 'Management of Working Capital in Public Enterprises' concludes that firm's liquidity and profitability are negatively correlated (Mukherjee, 1988). Embracing the World through Hospitality Course Essay Traveling is one of the most exciting and adventurous experiences that an individual could ever have in his or her life. Almost everyone has a dream of traveling the world to see the things beyond their horizon. It has been said that an individual who travels a lot, learns and experiences a lot. This is one of the reasons why I chose to take a hospitality course. Aside from the fact that I do love traveling, I also wanted to learn and experience more. I want to discover all the wonders of the world and be able to share it with other people. Among the greatest experiences that contribute to my desire to be involved in hospitality service are my travel experiences in various countries like South Africa, Senegal, Brazil, Trinidad and Tobago, and Jamaica. Through these experiences, I came to realize how wonderful our civilization is. I also came to discover that there are other rich cultures outside my territory and knowing other culture has made me aware how important the concepts of understanding is. I grew up in a country where racism is prevalent. The differences among cultures are the reasons why some people tend to harm people who behave differently from them. My travel experiences taught me the value of going beyond our horizon and getting to know other people as well. Their knowledge and experiences might be helpful and significant in one way or another as we traverse the roads of our life. I want to discover the world. This is also one of the reasons why I want to take a hospitality course. The importance of discovering the world would make us more academically, emotionally, mentally and physically involved in promoting the good of what we have. Indeed, like plants and animals, we are inhabiting a place that is more mystical and complicated in many sense. But unlike these creatures, we have the power to think and act according to what would be good for this earth. I may sound like a Miss Universe candidate answering a question that is likely to influence my audience, yet my claim that we could do more things to make this world more comprehensible, best managed, and taken cared of is indeed possible. Through hospitality course, I know in my self that I could be one of those individuals working to promote the best of this world. Moreover, studying the different aspects of our society, specifically of the different countries, would make me aware of how these countries, despite their differences, were able to build and employ an international relationship that has unity and coherence. Knowledge in history, economy, politics and other important aspects or systems of different countries would enable me to devise an activity or program that would promote understanding and encourage unity from different people. Through this, people with racist attitude might be reduced, particularly in many racist countries. Indeed, my love of traveling in different places made me a more open person, with lots of dreams for my country and for the whole world as well. My travels and discovery of other cultures such as what people in South Africa, Senegal, Brazil, Trinidad and Tobago, and Jamaica also made me a more knowledgeable and improved individual such that embracing other peoples culture and studying the different systems of their country have enlightened me that it is not enough that I am living within my horizon because life and discovery beyond this is significant in many ways as we are living in a diverse world. I do hope to become a part of the hospitality industry for me to be able to share to other people how wonderful our complex world is, how important hospitality industry in supporting the countrys economy, and how understanding differences in culture and other systems make us a better person. In addition, I hope to become a part of the hospitality industry for me to be able to serve the diverse people of this world in the most applicable and appropriate way that would satisfy them and make them realize how wonderful it is to travel and discover the world.

Part Five Chapter V

V Krystal was walking along Foley Road in the early morning sunlight, eating a banana. It was an unfamiliar taste and texture, and she could not make up her mind whether she liked it or not. Terri and Krystal never bought fruit. Nikki's mother had just turfed her unceremoniously out of the house. ‘We got things to do, Krystal,' she had said. ‘We're going to Nikki's gran's for dinner.' As an afterthought, she had handed Krystal the banana to eat for breakfast. Krystal had left without protest. There was barely enough room for Nikki's family around the kitchen table. The Fields were not improved by sunshine, which merely showed up the dirt and the damage, the cracks in the concrete walls, the boarded windows and the litter. The Square in Pagford looked freshly painted whenever the sun shone. Twice a year, the primary school children had walked through the middle of town, crocodile fashion, on their way to church for Christmas and Easter services. (Nobody had ever wanted to hold Krystal's hand. Fats had told them all that she had fleas. She wondered whether he remembered.) There had been hanging baskets full of flowers; splashes of purple, pink and green, and every time Krystal had passed one of the planted troughs outside the Black Canon, she had pulled off a petal. Each one had been cool and slippery in her fingers, swiftly becoming slimy and brown as she clutched it, and she usually wiped it off on the underside of a warm wooden pew in St Michael's. She let herself into her house and saw at once, through the open door to her left, that Terri had not gone to bed. She was sitting in her armchair with her eyes closed and her mouth open. Krystal closed the door with a snap, but Terri did not stir. Krystal was at Terri's side in four strides, shaking her thin arm. Terri's head fell forwards onto her shrunken chest. She snored. Krystal let go of her. The vision of a dead man in the bathroom swam back into her subconscious. ‘Silly bitch,' she said. Then it occurred to her that Robbie was not there. She pounded up the stairs, shouting for him. †M'ere,' she heard him say, from behind her own closed bedroom door. When she shouldered it open, she saw Robbie standing there, naked. Behind him, scratching his bare chest, lying on her own mattress, was Obbo. ‘All righ', Krys?' he said, grinning. She seized Robbie and pulled him into his own room. Her hands trembled so badly that it took her ages to dress him. ‘Did ‘e do somethin' to yer?' she whispered to Robbie. †M'ungry,' said Robbie. When he was dressed, she picked him up and ran downstairs. She could hear Obbo moving around in her bedroom. ‘Why's ‘e ‘ere?' she shouted at Terri, who was drowsily awake in her chair. ‘Why's ‘e with Robbie?' Robbie fought to get out of her arms; he hated shouting. ‘An' wha' the fuck's that?' screamed Krystal, spotting, for the first time, two black holdalls lying beside Terri's armchair. ‘S'nuthin',' said Terri vaguely. But Krystal had already forced one of the zips open. ‘S'nuthin'!' shouted Terri. Big, brick-like blocks of hashish wrapped neatly in sheets of polythene: Krystal, who could barely read, who could not have identified half the vegetables in a supermarket, who could not have named the Prime Minister, knew that the contents of the bag, if discovered on the premises, meant prison for her mother. Then she saw the tin, with the coachman and horses on the lid, half-protruding from the chair on which Terri was sitting. ‘Yeh've used,' said Krystal breathlessly, as disaster rained invisibly around her and everything collapsed. ‘Yeh've fuckin' – ‘ She heard Obbo on the stairs and she snatched up Robbie again. He wailed and struggled in her arms, frightened by her anger, but Krystal's grip was unbreakable. ‘Fuckin' lerrim go,' called Terri fruitlessly. Krystal had opened the front door and was running as fast as she could, encumbered by Robbie who was resisting and moaning, back along the road.

My first fight

I was a ferocious lion. I lost my temper uncontrollably. Nathan was bleeding incessantly from his nose. Blood imputed on my right knee and my left hand. The entire playground stood motionless. I could perceive each and every person looking at me with sheer admiration. They gazed at me like I was a lion and Nathan was a gazelle, regardless of Nathan being virtually twice my stature. I can still remember the events of my first fight as if they took place yesterday. I was pushed in to taking part in such an abhorrent incident on the first day of primary school during my first six months in the country. My uncle revealed to me that the reason that I had not begun school immediately was because my family arrived to the country halfway through the academic year. My family and I had just started to settle down in the country, adapting to the weather and the environment when my parents wounded me with the news that they had found me a school to grace with my presence. Endeavouring to learn a new language was demanding enough, let alone new children, teachers and books all of whom spoke a different language. The majority of the children in my class had all attended the nursery and infants before entering primary school. Therefore, I did not share, or relate to the experiences they shared together, like playing with the sand building castles, competing in various skipping games, riding on bicycles, drinking milk in the afternoons and having much fun with the paint. As a result, I felt disconcerted by so many questions rushing through my head. Was I going to be accepted into one of or any of these groups of eight year olds? Was I going to be the only one without a partner when doing paired work? Was I going to be the only one sitting unaccompanied in the dining hall? Unfortunately, the events that took place aggravated me more than I expected. On the first day when the teacher was introducing me to the class, I felt so unbefitting and mortified when she publicized I had just arrived from another country. There was that split-second when some of the children looked at me like I was an outsider, an alien. Voices were whispering from each corner of the room â€Å"who is he?† I felt isolated, remote, and would never have contemplated that after two days their thoughts would be on the contrary. After being introduced to the class by my teacher, Ms fielding introduced me to Carl, who would accompany me for the day. She then seated the pair of us on a table with two other children Nathan and David. It was time for literacy hour and everyone had to write about what they accomplished over the half-term break. As my skills were not to the standard of the other children, I decided to have a peak at what the others were writing about. To my amazement, nobody actually seemed to be doing any work apart from Carl, who later spent the majority of the morning session at the toilet. Meanwhile, David decided to smell a mixture of pens, which to this day I think is very peculiar. Nathan had written down the title â€Å"My First Fight†, but then started to doodle on a spotless new table. David brought his sniffing to a standstill and began a conversation with Nathan about football. The rest of the class were having extremely noisy conversations, in contempt of the teacher's numerous shrieks to bring the noise to an end. It seemed that she had absolutely no control over people a third of her age. Nevertheless, there was one person who had an immense effect on the class, Mrs Fassal, the deputy-head teacher. The second she walked in the class was so quiet a pin drop could be heard. As she walked in she had a quick glance around the classroom and she became aware of the vandalising offence Nathan had committed. She bellowed at our table asking â€Å"Who did it?† There was a slight pause. The whole class was listening as if they were an audience to a verdict. Mrs Fassal shouted again, â€Å"Who did it?† â€Å"The new boy did it Mrs Fassal†, Nathan alleged. â€Å"Yeah, the new boy did it Mrs Fassal†. David accused. â€Å"And you Carl, did you see anything?† â€Å"No Miss, I was at the toilet† Carl replied. I felt trapped like a wild animal in a cage big enough only for a mouse. I was so infuriated with Nathan's spitefulness, blaming me for his relentless vandalising acts. Nonetheless, I had a feeling that soon, very soon, Nathan would pay for his horrendous accusations. Mrs Fassal would not listen to any of my cries for help. However, she kept me back at morning break and yelled at me so loud, Carl later said he heard her in a playground full of screaming children. After morning break, I remained with Mrs Fassal until lunchtime, but I was sanctioned to have my lunch break. As Carl was my escort for the day, he invited me to play a game of football with him and his friends. Nevertheless, some of Carl's acquaintances particularly Nathan, seemed uptight on the subject of allowing me to engage in recreation. I was not perturbed in the slightest way, even so Carl managed to persuade them for me to join the game. During the first five minutes of the game, I did not touch the ball, instead I decided to see how everyone played. It emerged that Nathan was physically the biggest in comparison to the other boys and was using this to his advantage. I noticed that all Nathan was doing was jostling anyone that came near him, or whenever he wanted the ball. None of the players seemed to confront Nathan or show any sign of discomfort. Instead, they gave out the impression they were frightened Nathan would hurt them if they showed any sign of discomposure. Throughout my observation of the game, unexpectedly the ball arrived at my feet. Nathan was scampering towards me. We all knew what he was out to do. He had that look on his face like a tiger just about to take down his prey. Passing the ball was not an option, it was a game of knockouts, and it was everyman for himself. There were two options available to me, either to be clamped down and fall to the ground, or move out the way as soon as he lunged at me. I felt like a gazelle being run at by a lion. It was a split-second decision, so I decided to kick the ball to the left and spin around to the right as soon as he lunged at me. He fell to the ground as if he had been shot in the back. The entire playground stood in total and complete amazement. Nathan was a raging bull. He went on his knees and tilted his head up with a fuming look, as though he was about to eradicate someone. I warned him and said â€Å"No fighting, fighting no good† however I knew he was going to take no notice. He roared like a lion and charged at me like a rampant bull. As Nathan tried to rugby tackle me I seized him in a headlock and kneed him in the face continuously. Fortunately, for Nathan we were detached by Mr Chiriste, the school keeper. All the anger Nathan had caused me earlier, all the fury, all the upset, in addition to me being yelled at until I nearly cried was released in those few seconds. Thankfully I did not get into a great deal of trouble despite the fact I caused Nathan to bleed. The majority of the children in the playground backed me up by saying Nathan started the fight and I fought in self-defence. The chance of me losing my temper was as likely as Mike Tyson not losing his after being slapped in the face. Even at the tender age of eight, I never lost my temper unless exceedingly provoked. It is almost impossible to imagine what it takes for such a tranquil eight year old to reach that point of anger. On that particular Wednesday, that level of anger was caused by Nathan Tyler, and he paid the price for his actions. Looking back on my first fight, I think it is quite comical why I became so discoloured over such a minor incident. If I was in Nathan's situation I would have almost certainly preferred to blame the new boy, rather than face a monster like Mrs Fassal. Nevertheless, the thought of eight year olds making each other bleed is quite frightening.

Definition and Examples of a Written Summary of Text A summary, also known as an abstract, precis, or synopsis, is a shortened version of a text that highlights its key points. The word summary comes from the Latin, sum. Examples of Summaries A Summary of the Short Story Miss Brill by Katherine MansfieldMiss Brill is the story of an old woman told brilliantly and realistically, balancing thoughts and emotions that sustain her late solitary life amidst all the bustle of modern life. Miss Brill is a regular visitor on Sundays to the Jardins Publiques (the Public Gardens) of a small French suburb where she sits and watches all sorts of people come and go. She listens to the band playing, loves to watch people and guess what keeps them going and enjoys contemplating the world as a great stage upon which actors perform. She finds herself to be another actor among the so many she sees, or at least herself as part of the performance after all....One Sunday Miss Brill puts on her fur and goes to the Public Gardens as usual. The evening ends with her sudden realization that she is old and lonely, a realization brought to her by a conversation she overhears between a boy and a girl presumably lovers, who comment on her unwelcome pr esence in their vicinity. Miss Brill is sad and depressed as she returns home, not stopping by as usual to buy her Sunday delicacy, a slice of honey-cake. A Summary of Shakespeares HamletOne way of discovering the overall pattern of a piece of writing is to summarize it in your own words. The act of summarizing is much like stating the  plot of a play. For instance, if you were asked to summarize the story of Shakespeares Hamlet, you might say: Its the story of a young prince of Denmark who discovers that his uncle and his mother have killed his father, the former king. He plots to get revenge, but in his obsession with revenge he drives his sweetheart to madness and suicide, kills her innocent father, and in the final scene poisons and is poisoned by her brother in a duel, causes his mothers death, and kills the guilty king, his uncle. This summary contains a number of dramatic elements: a cast of characters (the prince; his uncle, mother, and father; his sweetheart; her father, and so on), a scene (Elsinore Castle in Denmark), instruments (poisons, swords), and actions (discovery, dueling, killing). -Richard E. As a general rule, you should not include your own ideas or interpretations. Usually, a summary has between one and three paragraphs or one hundred to three hundred words, depending on the length and complexity of the original essay and the intended audience and purpose. Typically, a summary will do the following: Cite the author and title of the text. In some cases, the place of publication or the context for the essay may also be included.Indicate the main ideas of the text. Accurately representing the main ideas (while omitting the less important details) is the major goal of the summary.Use direct quotations of keywords, phrases, or sentences. Quote the text directly for a few key ideas; paraphrase the other important ideas (that is, express the ideas in your own words.)Include author tags. Definition of Race Essays - Social Constructionism, Free Essays Definition of Race Victoria Mullally SOC/262 February 29, 2016 Erica Lloyd Race defined by Merriam-Webster dictionary is a category of humankind that shares certain distinctive physical traits ("race," n.d.). Over time race is has proven to be so much more than that. The current view of race is more socially constructed than it is biological. Traditionally race has been looked at in a biological manner. This means that race was defined simply by viewing people by biologically inherited factors. (I.e. DNA) Obviously DNA is a small portion of what people consider to be a racial distinction. Biological factors are scientific. This also means that they will never change. Blacks would be considered black in all parts of world as would whites. However, this is not the case. A person who could be categorized as black in the United States might be considered white in Brazil or colored in South Africa. (Onwuachi-Willig, 2015, para. 1). If race remained a scientific/biological construct it would not change based on a persons view. In todays society the science of race is lost. People view race in a manner of their own personal perception. If a person views themselves as a superior race their reasoning will be considerably different than that of another, whom considers themselves superior. One person may consider themselves superior due to their wealth, while another may consider themselves superior due to their religious background. With the many variations in what society considers race its no wonder race is such a dominate factor in American culture. Race is a socially constructed concept. (Schaefer, 2014, p. 9). Race only matters so much in America because we use it to define so many things. The creation of racial groups, ethnic groups, and gender groups simply goes to show how much emphasis is put on race. Racial groups are how people group those based on apparent physical differences. Ethnic groups are how people are grouped by national origin or distinctive cultural patterns. Gender groups are obviously the separation of males and females. By using these different groups you are essentially being racist. People within these groups have no choice of being a part of them. By society differentiating people in this way racism is going to be a never ending battle. Traditional views of race hindered the assimilation of underserved groups because race was a factor. By differentiating people by race we inhibit their assimilation into American society. I feel this is true because once people feel threatened by their race they hold onto it. If people assimilate to a society that is so set on race, they themselves give into a race conscious society. If race wasnt so important, then assimilating into American society would be less of a battle for underserved groups. All people of America would be much happier if they were not defined by any type of race, whether that is the traditional view or the contemporary view. The new definition of race in contemporary America is closely related to the melting pot approach. I feel that this is the only definition that still works because America is not changing for the better. In a melting pot approach it is defined as a place where different peoples, styles, and theories are mixed. ("Google", n.d.). This to me sounds like America. All different people, their styles, and theories are mixed together in one place. Although I do not feel as though these differences are melted. This is also why I would consider contemporary America as more of a salad bowl. A salad has different parts that are tossed together, but fail to mix/melt. I feel as though pluralism is what America should be working towards. Pluralism is about coexisting. If everyone in America felt that what they thought, how they dressed, what they looked like, and what religion they practiced were not being judged they would be able to coexist. Being able to coexist means being able to learn from one another. Learning from each other is the way the world should work. Finding new approaches to life rather than judging and hindering others for being different would make America a more beautiful place to live. Oliver Goldsmith's Classic Essay on the Man in Black Best known for his comic play She Stoops to Conquer and the novel The Vicar of Wakefield, Oliver Goldsmith was also one of the most prominent essayists of the 18th century. The Character of the Man in Black (originally published in the Public Ledger) appears in Goldsmiths most popular essay collection, The Citizen of the World. Though Goldsmith said that the Man in Black was modeled on his father, an Anglican curate, more than one critic has observed that the character bears a striking resemblance to the author: In fact, Goldsmith himself seems to have had difficulty reconciling his philosophic opposition to charity with his own tenderness toward the poorthe conservative with the man of feeling. . . . As foolishly luxurious as Goldsmith may have considered [the Man in Blacks] behavior, he apparently found it natural and almost unavoidable for a man of sentiment.(Richard C. Letter 26: The Character of the Man in Black, With Some Instances of His Inconsistent Conduct To the Same. 1 Though fond of many acquaintances, I desire an intimacy only with a few. The Man in Black, whom I have often mentioned, is one whose friendship I could wish to acquire, because he possesses my esteem. His manners, it is true, are tinctured with some strange inconsistencies; and he may be justly termed a humorist in a nation of humorists. Though he is generous even to profusion, he affects to be thought a prodigy of parsimony and prudence; though his conversation be replete with the most sordid and selfish maxims, his heart is dilated with the most unbounded love. I have known him profess himself a man-hater, while his cheek was glowing with compassion; and, while his looks were softened into pity, I have heard him use the language of the most unbounded ill-nature. Some affect humanity and tenderness, others boast of having such dispositions from nature; but he is the only man I ever knew who seemed ashamed of his natural benevolence. He takes as much pains to hide his feelings, as any hypocrite would to conceal his indifference; but on every unguarded moment the mask drops off, and reveals him to the most superficial observer. 2 In one of our late excursions into the country, happening to discourse upon the provision that was made for the poor in England, he seemed amazed how any of his countrymen could be so foolishly weak as to relieve occasional objects of charity, when the laws had made such ample provision for their support. In every parish-house, says he, the poor are supplied with food, clothes, fire, and a bed to lie on; they want no more, I desire no more myself; yet still they seem discontented. I am surprised at the inactivity of our magistrates in not taking up such vagrants, who are only a weight upon the industrious; I am surprised that the people are found to relieve them, when they must be at the same time sensible that it in some measure encourages idleness, extravagance, and imposture. Were I to advise any man for whom I had the least regard, I would caution him by all means not to be imposed upon by their false pretences; let me assure you, sir, they are imposters, every one of them; and rather merit a prison than relief. 3 He was proceeding in this strain earnestly, to dissuade me from an imprudence of which I am seldom guilty, when an old man, who still had about him the remnants of tattered finery, implored our compassion. He assured us that he was no common beggar, but forced into the shameful profession to support a dying wife and five hungry children. Being prepossessed against such falsehoods, his story had not the least influence upon me; but it was quite otherwise with the Man in Black: I could see it visibly operate upon his countenance, and effectually interrupt his harangue. I could easily perceive, that his heart burned to relieve the five starving children, but he seemed ashamed to discover his weakness to me. While he thus hesitated between compassion and pride, I pretended to look another way, and he seized this opportunity of giving the poor petitioner a piece of silver, bidding him at the same time, in order that I should hear, go work for his bread, and not tease passengers with suc h impertinent falsehoods for the future. 4 As he had fancied himself quite unperceived, he continued, as we proceeded, to rail against beggars with as much animosity as before: he threw in some episodes on his own amazing prudence and economy, with his profound skill in discovering impostors; he explained the manner in which he would deal with beggars, were he a magistrate; hinted at enlarging some of the prisons for their reception, and told two stories of ladies that were robbed by beggarmen. He was beginning a third to the same purpose, when a sailor with a wooden leg once more crossed our walks, desiring our pity, and blessing our limbs. I was for going on without taking any notice, but my friend looking wistfully upon the poor petitioner, bid me stop, and he would show me with how much ease he could at any time detect an impostor. 5 He now, therefore, assumed a look of importance, and in an angry tone began to examine the sailor, demanding in what engagement he was thus disabled and rendered unfit for service. The sailor replied in a tone as angrily as he, that he had been an officer on board a private ship of war, and that he had lost his leg abroad, in defence of those who did nothing at home. At this reply, all my friends importance vanished in a moment; he had not a single question more to ask: he now only studied what method he should take to relieve him unobserved. He had, however, no easy part to act, as he was obliged to preserve the appearance of ill-nature before me, and yet relieve himself by relieving the sailor. Casting, therefore, a furious look upon some bundles of chips which the fellow carried in a string at his back, my friend demanded how he sold his matches; but, not waiting for a reply, desired in a surly tone to have a shillings worth. The sailor seemed at first surprised at his demand, b ut soon recollected himself, and presenting his whole bundle, Here master, says he, take all my cargo, and a blessing into the bargain. 6 It is impossible to describe with what an air of triumph my friend marched off with his new purchase: he assured me that he was firmly of opinion that those fellows must have stolen their goods who could thus afford to sell them for half value. He informed me of several different uses to which those chips might be applied; he expatiated largely upon the savings that would result from lighting candles with a match, instead of thrusting them into the fire. He averred, that he would as soon have parted with a tooth as his money to those vagabonds, unless for some valuable consideration. I cannot tell how long this panegyric upon frugality and matches might have continued, had not his attention been called off by another object more distressful than either of the former. Each members of the family has repressed wish that distinguished their character from another. In a way, this is the typical American family with their economical and social structure and reacting normally with the involvement of the other big factor that made the twist of the story – the factor of Money. With the flow of the story, the struggles the family had in dealing with their situations after the death of the father caused them to create the ideal situations in their head of what needs to be done. There remained their intentions to have better life for their family and better life for themselves individually. This later tested their grasp with their family ties. With the individual conception of what is good, what can only go wrong is the inability to be in alignment of what you wanted with what other family members wanted. It can also become a consequent question of whether you hold fast to your dreams or hold on to the bigger picture of what needs to be done as part of the family (Mintz and Kellogg 38). The characters of the play supplied the dreamers role and collectively, a set of contrasting roles carrying ideas and subjects. Set in mid 1800’s, the story was centered in the dreams of the Younger Family and clashes with prejudices that the characters had as they strive to have a better position in their community as a whole. Perspective to be used in the Analysis There are schools of thoughts that are highly applicable with the study of the family being portrayed in this play written by Lorraine Hansberry: first, we can see it in the perspective using functionalism or second, it can be through interactionism. Later, this will be used to reveal how the dreams are being formed and what the motivations that determined the creation of these dreams are. These are the schools that traced the families in America with their way of being developed, managed and designed. The material variable in the family structure can be seen through the role they are playing and be analyzed objectively. Also, we can also see it from the perspective of an interactionist who is primarily concerned with the way the people are acting in response to other people or situations. Yes, these schools have difference with the primary objects of their concern, but essentially they contribute with the thorough understanding with the functions and interactions aspect of a family (Hamilton 47). It can give us the ideas of where the dreams of the characters in the story are actually directed. The Dreamers, their Motivations, and the Clash It all started with Ten Thousand Dollars. The characters of the play provided the audiences with the humanistic range of possible thought process that can be derived from a single source of stimulus. There was an emphasis given earlier with the role of Money in this story for this is the stimulus that moved the characters to make their stand. The money pertains to the $10,000 insurance amount that Lena Younger, the maternal character not just a mother figure, got after her husband passed away. Lena is also called Mama in the story and she possessed the maternal qualities that exhibit a picture of a loving, caring, and understanding woman. Such a woman only has one goal in life – To make her children happy or happier with all of her ability. The material figure that conveyed this goal of Mama is the house that she bought for $3,000. It symbolizes the unity, stability, and economical status that she believes to be important for her family (Morrin and Hansberry 35-38). The picture of the house portrayed the whole dream of Lena. It extends from the social ground of its manifestation to the subtle emotion a mother could possibly feel. This dream clashes with her son’s concerns. Walter, the son, has concerns about the Money that can be categorized as the dream for continuous economic stability of the family. When it comes with the nature of his character, he can be the figure that represents masculine authority of the story. He supplied the protagonist role but with his racial prejudices paired with his conflicts while performing both role of a son and a husband makes him supply his own contrast as an antagonist. Walter became not excited about the house bought by Mama. He has ulterior motives for the money and had a clear image in his mind on what to do with the money. As a masculine role, the story puts more authority in Walter’s hand as he got the control over the Insurance money and managed it. Lena put his trust on Walter and this shows how Lena is more than willing to give whatever her child wants. Though this doesn’t show any touch of negligence in her part. The acquisition process of the dream in this context doesn’t have any conflict yet. The conflict happened with the aftermath of the decision that placed Walter in the position of higher authority with the Money. The first clash of dream is done with the two given characters and the structure of both dreams must be observed carefully. We can notice the function of money ranges from how it fueled the quest for the dream to the conflict the two characters had. The conflict didn’t last since one of these two dreams was restructured. Lena, whose dream is to provide what her children wanted still managed to achieve it in a way by fueling Walter’s procedure of achieving his dream. There was a conflict because the functions of the house Lena bought don’t go with the alignment of Walter’s dream. It was settled because Lena followed that alignment as a response without violating her desires that is basically structured solely for the happiness of her children. The other child of Lena is Beneatha, the twenty year old woman, who had dream of being a physician. She is considered as intellectual and also an ambitious college student and required Money for the matriculation of the course. The conflicts Beneatha had are related to the money she required for her education and this is directed to Walter who has the control over it. Her sole dream of becoming a doctor will be compromised without the money. She got mad at Walter when she learned that Walter did not put any amount for her study. It seems like a big turnaround from all of her aspirations and she went depressed. This clash is apparently hard for Beneatha since, if money is the fuel for her actions in making her dreams realized, then it is a big contrast to have none of it. Her dream almost vanished. How did she turn out to continue seeing hoe despite of what happened? There is another character named Asagai who became the voice of realization. He made Beneatha realized the key thing about this vision of the dream she formed in her head. The dream had already been in her thoughts even prior to the death of his father, so it means that equating money to her dream is a big nuisance. It would be similar to the terrible equation of his father’s death hand in hand with the money. This showed that there remained to be ways on how it could be fulfilled without that so-called fuel of money. It can be money coming from different source instead. Beneatha realized this important thing, found her hope, continued dreaming. With the structure of their dreams, it is apparent that money equates house, then money equates liquor store and finally, money equated matriculation. With its many form, money remained to be the prime motivation that was shown in the play. The big question would be, along this clash of dreams, for how long can money control or determine the actions of the characters? On the mid part of the play, Walter was betrayed by his business partner leaving him with no money. There came the confrontations with Walter and the other characters especially with his wife, Ruth, who was also driven by dreams of having financial stability. It made them start from the scratch and all realizations that they need were established. Money is just a motivation but never a determinant of the quality of life that a harmonious family could have. Moreover, the dreams are manifestations that we are living while seeking whatever we want out of life. Money is not much important although, yes, it rates reasonably as oxygen. Lorraine Hansberry’s approach in tackling the concept of American dream showed that Money can either be seen as a fuel or an obstacle. The dreams that we have though is a picture of what we can do. Resonance Frequency Analysis Tool for Implant Stability Dr. Vishwanath Pattar Dr. Anjana Bagewadi MDS â€Å" Resonance frequency analysis (RFA) – A diagnostic tool for implant stability † Dental implants have become a significant aspect of tooth replacement in prosthodontic treatment. High implant success rates of the order of 78-100 % have been published, with more than 15 years of observation time. Treatment success of dental implant mainly depends on the stability of the implant bone support. Implant stability is a mechanical phenomenon which is related to the local bone quality and quantity, type of implant, and placement technique used. The application of a simple, clinically applicable, non-invasive test to assess implant stability and osseointegration is considered highly desirable. Resonance frequency analysis (RFA) is one of such techniques which is most frequently used nowadays. Aim of this paper is to review the technique of Radio frequency analysis and use of it to check the implant stability. Key words: Resonance frequency analysis, Implant stability, Implant stability quotient(ISQ) Introduction : Dental implants have reported success rates of over 90 % over long periods of time. However failures still occur and seem to be unpredictable. One factor that is being increasingly considered in failure of dental implants is occlusal loading . It has been clinically demonstrated that implant stability plays a significant role in determining treatment outcome (Sennerby Meredith 1998, Esposito et al. 1998). Implant stability can be seen as a combination of: 1). Mechanical stability, which is the result of compressed bone holding the implant tightly in place.2). Biological stability, which is the result of new bone cells forming at the site of the implant and osseointegration. Initially implant stability was measured by Surgeon’s perception while placing the implant (Insertion and seating torque), percussion testing, reverse torque test and radiographs etc. But none of them proven to be effective in measuring the implant stability. Resonance Frequency Analysis (RFA) is a non-inv asive diagnostic tool for detecting the implant stability of dental implants during the healing stages and in subsequent routine follow-up care after treatment. Advantages of Rasonance frequency analysis 1) Optimal loading decisions : It makes it easier for dentists to decide when is the optimal time to load implants. At placement, stability can be difficult to quantify objec ­tively by merely relying on tactile perception. Torque measure ­ments are difficult to repeat once the implant has started to integrate and can therefore not provide a baseline for subse ­quent comparisons. The invasive torque method may even damage the healing if used for monitoring osseointegration 2)  Early warnings – preventing failure : Dentists sometimes encounter patients whose initial stability score is low. The reason could be that they have had to undergo a bone graft. In such higher-risk situations, most surgeons would avoid an early-loading protocol. Similarly, a significant decrease in stability indicates a potential problem and should be considered an early warning. The surgeon may prefer to unload the implant – or perhaps place additional implants – and then wait until stability increases. RFA system makes the treatment of high-risk patients easier and more predictable – allowing more of these patients to be treated and more of their treatments to be successful. 3)  Quality assurance : Because RFA system helps the dentist decide when to load and avoid failure in high-risk situations, it becomes a quality-assurance system for the clinic. Most patients intuitively understand the stability measures and how they govern when to load an implant and when to wait. This increases their sense of confidence, security and quality. 4) Data can be transferable : All the stability records measured from start of the treatment and the follow –up records can be transefered from one clinician to other. It makes easy to the one clinician to communicate with other about the treatment modalities. Implant stability quotient (ISQ) ISQ (Implant Stability Quotient) is a measurement scale for use with the RFA (Resonance Frequency Analysis) method of determining implant stability. It’s a mapping of resonance frequencies (kHz), presented as a clinically useful scale of 1-100 ISQ. 1 is the least ISQ value and 100 is the highest ISQ value. ISQ is used RFA to measure stability because Supports making good decision about when to load Allows advantageous protocol choice on a patient-to-patient basis. Indicates situations in which it is best to unload Supports good communication and increased trust Provides better case documentation Instrument kit: Fig.1 Hand held probe Fig.2 MonitorFig.3 Main plug Fig.4 Data cable Fig.5 Testing device Fig.6 Smart-peg Technique : Resonance frequency analysis (RFA) uses a sophisticated technology with computer-based measurement of resonance frequency (RF), which is determined by two parameters: the degree of bone density on implant-bone interface area and the level of marginal alveolar bone around the transducer Osstell is representative of RFA-technique and was tested first in 1997The apparatus consists of an Osstell transducer and Osstell analyzer connected to a PC or independent. The transducer is L-shaped or bolts-like (smartpeg) and firmly screwed in order to be positioned on the implant and its superstructure (4–5 N/cm ²) and consists of 2 small voltage controlled transducers. High-energy pulse-type oscillations of a continuous sinusoidal pulse excite implant, in order to register the mechanical vibration between the implant interconnection zone and the bone. As soon as the apparatus is activated the first electric transducer applies excitation signal of increasing frequency from 5 to 15 kHz to implant. Other voltage-controlled element registers ultrasonic vibrations response, ie resonant frequency of the implant-bone interface area and transmits a created signal to the amplifier, which amplifies it and to the analyzer which reads, evaluates and compares it with the frequency of the original signal. The measured amplitude of resonance frequency is displayed numerically and graphically on the Osstell analyzer, and the maximum amplitude represents the stability of the implant, quantified through the ISQ units. The ISQ value reflects the rigidity of the system transducer- implant-bone and transducer calibration parameters. Measured on a scale from 0 ISQ (3500 Hz) to 100 ISQ units (8500 Hz), a higher ISQ value indicates a greater stability of the implant. After a while ISQ values rise because of osseointegration where implant–bone the connection becomes stronger. The converging green curves show the two most likely scenarios: implant stability eventually sets at around 70 ISQ. A high initial ISQ value tends to decrease, as mechanical stability is supplanted by osseointegration. And a low initial value tends to increase, as osseointegration sets in. The scenario to watch out for is illustrated by the red curve. Here, osseointegration is not progressing as planned, and loading such an implant may result in a failed treatment†¦ High initial stability (ISQ values of 70 and above) tends not to increase over time despitethe fact that the initial high mechanical stability decreases and is replaced by increased biological stability. Lower initial stability normally increases with time because the lower  mechanical stability is increased by the bone remodeling process (osseointegration). Learning Racism in Going to Meet the Man by James Baldwin James Baldwin, an African American author born in Harlem, was raised by his violent step-father, David. His father was a lay preacher who hated whites and felt that all whites would be judged as they deserve by a vengeful God. Usually, the father's anger was directed toward his son through violence. Baldwin's history, in part, aids him in his insight of racism within the family. He understands that racists are not born, but rather racist attitudes and behaviors are learned in the early stages of childhood. Baldwin's Going to Meet the Man is a perfect example of his capability to analyze the growth of a innocent child to a racist. Every child is born with innocence. During the flashback to Jesse's childhood, where he witnesses the mutilation and torture of a blackman, Jesse's innocence is apparent. Jesse has a black friend named Otis who he hasn't seen for a few days. When he asks his father where Otis is, the father replies, "I reckon Otis's folks was afrad to let him show himself this morning"(Baldwin, p. 2006). Jesse naturally responds, "But Otis ain't do nothing." His father explains, "We just wanna make sure Otis don't do nothing, and you tell him what your Daddy said"(Baldwin, p. 2006). This statement implies that because Otis is black, he is eventually going to do something wrong. The father has subconsciously put negative thoughts inside of Jesse's head. Baldwin's own father also acted in this way when he stereotyped all whites as being bad and claimed they would be punished by God. In the midst of all the commotion, Jesse is unable to sleep the night before the lynching. Within another flashback to that night, Jesse feels a strong need to have his ... ...se toward the father has replaced the longing for the mother. "Jesse loved his father more than he had ever loved him"(Baldwin, p. 2010). He feels like a man because, "his father had carried throught a mighty test, had revealed to him a great secret which would be the key to his life forever." He subconsciously traded his innocence for closness to his father. Going to Meet the Man allows readers to recongnize how a racist is built through ingnorance. Baldwin ends his story with Jesse in bed with his wife. The memories of the mutilation of the negro arise in his mind and he feels arrounsed. He turns to his wife and says, "Come on sugar, I'm going to do you like a nigger." Jesse cannot recognize that these memories of the lynching have made him sexually arroused by violence. As a result, he has become a violent man with a disturbed idea of love, sex and blacks.

Genetic Engineering on Humans Essay

Visualize a world where anyone can do anything, regardless of age or physical conditions. Nobody would age nor develop any illnesses or disorders. Essentially, this would be a society in which everyone is perfect. Such a thought would be the result of genetic engineering, which is the modification of an organism’s genome using biotechnology. Scientists alter the genetic makeup of an organism by using techniques that remove inherited material or inject DNA from outside the organism either directly into the host or into a cell that is then crossbred with the host (Clapper, 2013). The goal of genetically modifying organisms is to fix imperfections and improve their capabilities. In humans, genes that cause diseases and disorders can be identified and defenses can be put up to fight them. After hours of research and weeks of studying on the topic, I have reached a conclusion that humans should be able to be genetically engineered, but there needs to be a limit to how much they are modified. Some benefits of this include the absence of diseases, the ability for parents to choose the physical traits for their child, and increased human capabilities. One major benefit of the genetic engineering of humans is the termination of physical disorders. Life without diseases would mean that everyone, no matter the age, would be healthy and capable of doing whatever they please. The Human Genome Project is currently working on identifying all the genes in the human body and their purposes (Hanna, 2006). They will then be able to work on preventing diseases by removing or replacing the defective gene in a process known as gene therapy. In the movie GATTACA, Vincent, who was born without the aid of genetic selection, was tested to show that he had a high probability of developing mental disorders as well as a heart defect (GATTACA, 1997). However, the second son Anton, who was genetically modified, is perfectly healthy and is predicted to live forever. This shows that genetic engineering can indeed alter or even fully eliminate disorders or negative conditions. For example, scientists using gene therapy  were able to cure twenty two children with severe combined immunodeficiency, providing the first strong piece of evidence that this process was effective (Campbell, Reece, and Simon, 2007). In addition, another way in which genetic engineering could be a benefit is that parents would be able to choose how they want their child to turn out. According to the article Pros and Cons of Genetic Engineering in Humans, parents could alter their baby’s appearance however they want to (Bird, 2011). Genetic engineering can also be used to eliminate superficial traits parents may perceive as flaws, such as oversized ears for example. In GATTACA, the parents chose to use genetic selection to conceive their second child Anton (GATTACA, 1997). Julian Savulescu, a philosopher and bioethicist, believes that genetically engineering will soon have developed to affect an individual’s personality instead of just their physical appearance (Alleyn e, 2012). He argues that, â€Å"rational design would help lead to a better, more intelligent and less violent society in the future.† This means that future genetically modified children could not only be physically attractive but also better people in general, capable of making smarter decisions. Last but not least, genetic engineering could provide us with better capabilities. Humans could be modified to have superhuman strength and immeasurable intellect. Animals can be modified have human traits, so humans should theoretically also be able to be engineered with physical characteristics from different species. A National Human Genome Research Institute team reported a mutation in a gene that codes for a muscle protein known as myostatin which can increase muscle mass and enhance racing performance in a breed of dogs (Sato, 2009). Scientists wonder if human athletes could benefit from having a gene or two artificially mutated to give them a little extra strength and speed. GATTACA also shows how genetic engineering affected the bodies of the main characters. Anton was genetically altered to be far superior physically and mentally compared to his older brother Vincent (GATTACA, 1997). Based on the fact that the Department of Science and Technology states that crops will be able to grow on unfertile land and for newer functions, it is suggested that humans too can be genetically modified to perform higher level tasks (Haut, 2014). In every argument, there exists cons to balance out with the pros. People argue that having genetically engineered humans would decrease diversity. The world revolves around the differences between individuals and  their evolutionary process that occurs at some point. As mentioned early on, there should be limits placed on the modification. The physical traits of a person should be enhanced so that he/she can take upon newer and better functions, but the emotional character within them should be left untouched. Because each individual would still have their own personal thoughts, feelings, and opinions, genetic diversity would remain unchanged. In addition, genetically engineering humans would not necessarily be changing the process of evolution. Simply put, the progression would essentially be sped up to a point where it is easier for a species to develop their skills and abilities if they have been established early in their lives. Although there are some downsides to genetic engineering on humans, I believe that it is a necessary step that should be taken in the future. If our theories prove to be successful in experiments, we will be able to cure and possibly eradicate diseases. Parents would be satisfied with their child, knowing that they turned out exactly as pictured. And finally, people would have enhanced capabilities, allowing them to do much more with their physical fitness and knowledge. 10 Things I Hate About You

Many movies follow the typical â€Å"Hollywood pattern†, that is, they provide no greater meaning, no deeper purpose, than solely to entertain. However, this is not the case, as shown in ’10 Things I Hate About You’, directed by Gil Junger. The movie explores important ideas and themes, such as, the role of women in the 21st century, peoples judgments and the power that Shakespearean symbols hold. The movie breaks down the idea of the liberated woman of the 21st century. This is shown throughout the movie, but one main example is when the script-writer surprises us when we learn Kat’s reason for being an anti-emotional person.Scene 20 portrays the transformation in Kat’s life when her emotional poem reveals her love for Patrick. During the poem Kat surrenders to Patrick by crying in front of the class and admitting that â€Å"†¦mostly I hate the way I don’t hate you†¦Ã¢â‚¬ , shows, through the use of a paradox, that Kat wants to h ate Patrick but can’t. By using the repetition of a strong word like â€Å"hate† throughout the poem to make the once harsh word sound like a polite word used to describe one’s love. The movie also highlights that Patrick can control her. This is shown when Patrick gives Kat a guitar to make up for what he did.Patrick shows us that he knows that he has the power to control her, by saying â€Å"There’s always drums, and bass, and maybe even one day a tambourine†. Junger employs the use of shot/reverse shot editing to show Patrick’s reaction towards Kat when she is reading her poem. During editing Junger purposely makes the last shot in the scene longer to show Patrick and allow the viewers to process and think about what just happened. Another issue that is raised is about the stereotypical role of women in the 21st century is whether a woman needs a man to feel complete.This is suggested because the movie ends with everyone in a relationship . Also Kat says that she is an individual and does not like any males that go to her school. She later starts a relationship with Patrick, who goes to her school. This shows Kat’s transformation. The ending suggests to teenagers that to be â€Å"normal† you need to be in a relationship. The movie has an underlying message about being judgemental. Junger uses the setting of the school because during high school is when we are most judgmental.When we first see Kat, Bianca, Cameron, Patrick, Joey and Michael we are judgmental towards them. We judge them on the way they dress, speak, present themselves and by where they live. We as viewers watch Michael as he shows Cameron all the different groups in the school. We too as viewers of the movie are judgmental of Kat and Bianca. We first view the animated title and credits while girly music is playing, we than go into an establishing shot where we see the upper class suburb, with freshly mowed lawns , people walking their dog s, and flash cars.Bianca and her friends pull up at the pedestrian crossing; they are bouncing along to the music, this symbolises the â€Å"normal† fun-loving teenager. Then Kat comes along, in her beat up car. When the camera goes into a medium shot of her, the music changes into angry girl music, â€Å"I don’t give a dam about my bad reputation†. Bianca waits for the pedestrians to cross before continuing, but Kat drives through without waiting. This juxtaposition immediately makes us judge Bianca and Kat.The juxtaposition continues at school, when Cameron first sees Bianca, Junger uses non-diegetic sound creating moods which affect the viewer; it makes us believe that she is innocent. The use of juxtaposition makes us judge Kat and Bianca to the extreme thinking they’re not related in fact they’re sisters! The use of Shakespearean symbols explores important ideas and themes, showing the deeper purpose of the movie: to deliver a Shakespearean me ssage to teenagers. Throughout the movie there are lots of references to Shakespeare, giving clues on the inspiration of the film.A suggestion that the movie is delivering a Shakespearean message is when the English teacher, Mr Morgan, raps a Shakespearean sonnet. This immediately makes it appealing to teenagers. Another suggestion is the use of words that are stereotypically Shakespearean. One example is when Cameron first sees Bianca and Cameron describes how he feels â€Å"I burn, I pine, I perish†. Using these Shakespearean words gives teenagers a better understanding of what they mean. There are many references throughout the movie to Shakespeare’s life.Included in this is Bianca and Kats’ last name, Stratford, is a reference to Shakespeare’s birthplace, Stratford-Upon-Avon. The school’s Shakespearean architecture castle like design is a visual reference. We are shown the design of the school at the beginning through the use of a crane shot. I n scene 12, when Cameron and Michael advise Patrick to sacrifice his dignity to balance things, Michael uses Shakespearean language. This turns teens off, but when Patrick replies with â€Å"hey, don’t say shit like that, people can hear you†, brings the humour into the Shakespearean message. 10 Things I Hate About You† is not just another teen movie. It is a teen movie with a deeper message, a message about life. It addresses how women were perceived in the 50s, how teens don’t like Shakespearean language and how we are judgemental to people when we first see them. The movie includes posters in the classroom that makes us question out actions in life: â€Å"The first and worst of all frauds is to cheat oneself† and â€Å"What is popular is not always right; what is right is not always popular! †

Every state has adopted Article 3 of the Uniform Commercial Code (UCC), with some modifications, as the law governing negotiable instruments. The UCC defines a negotiable instrument as an unconditioned writing that promises or orders the payment of a fixed amount of money. Drafts and notes are the two categories of instruments.A draft is an instrument that orders a payment to be made. An example is a check. A note is an instrument that promises that a payment will be made. Certificates of deposit (CD's) are notes. Drafts and notes are commonly used in business transactions to finance the movement of goods and to secure and distribute loans. Negotiable instruments do not include money, payment orders governed by article 4A (fund transfers) or to securities governed by Article 8 (investment securities).The rule of derivative title, which is applicable in most area s of the law, does not allow a property owner to transfer rights in a piece of property greater than his own. If an instrument is negotiable this rule is suspended. A good faith purchaser, who does not have any knowledge of a defect in the title or claims against it, takes title to the instrument free of any defects or claims. In relation to the suspension of the rule of derivative title, Article 3 provides for warranties to protect the parties in transactions involving negotiable instruments.Checks are negotiable instruments but are mainly covered by Article 4 of the UCC. Secured transactions may contain negotiable instruments but are predominantly covered by Article 9 of the UCC. If there is a conflict between the Articles of the UCC both Article 4 and 9 govern over Article 3. 1 First chapter: Introduction 2 1. 1. Statement of The Study The word negotiable means ‘transferable by delivery’ and the word ‘instruments’ means a written document by which a righ t is created in favor of a person. Thus, the term negotiable instruments literally refer to a document containing rights that can be transferred by elivery. According to Section 13 (a) of the Act, â€Å"Negotiable instrument means a promissory note, bill of exchange or cheque payable either to order or to bearer, whether the word ‘order’ or ‘bearer’ appear on the instrument or not. † The rights that could be incorporated in negotiable instruments may be rights for payment of money arising out of various contracts such as the contract of loan, sale, lease, or any other contract performed by payment of a certain amount of money. Such rights may also arise from ownership in companies or loan made to the government or to a share company.The rights that are incorporated in negotiable instruments may be rights to receive goods under voyage or deposited in a warehouse. According to this provision, the holder of negotiable instruments can transfer the rights incorporated in the instrument by transferring the instrument. Similarly, a person who claims the rights incorporated in negotiable instruments may enforce or exercise them only if he has possession of the instrument, i. e. , he should be a holder to whom the instrument is issued or transferred following the rules governing its transfer.He must also present the instrument to the person who is supposed to perform the obligations arising out of the instrument. The fact that the rights incorporated in negotiable instruments may be transferred by the transfer of the instrument and the fact that a person may not exercise or enforce them unless he is in possession of the instrument are the two main features which distinguish negotiable instruments from other documents evidencing rights such as a title deeds whose transfer does not transfer the rights they establish.Another point that has to be noted here is that negotiable instruments are issued or negotiated based on other contracts. Fo r instance, a person may issue a bill of exchange to repay the money he has borrowed from the payee, the company issues a share certificate or debenture certificate as evidence of the person‘s right arising out of contract of partnership creating the company or a contract of loan respectively. The warehouse person or the carrier issues the warehouse goods deposit certificate or the bill of lading / consignment note based on contracts of warehousing or carriage respectively.Finally, the definition of negotiable instruments under the Ethiopian law is much wider than the one adopted by most legal systems, particularly those following the Common Law tradition. This is evident from the Uniform Commercial Code of the United States and the Bill of Exchanges Act of 1882, which restricts the concept to bills of exchange, cheques and promissory notes. 3 1. 2. Understand various provisions of negotiable instrument Act, 1881 regarding negotiation, assignment, endorsement, acceptance, etc. of negotiable instruments. 4 Second chapter: General Context of the Study 5 2. 1. Literature Review The term, negotiable instrument means a written document which creates a right in favor of some person and which is freely transferable.Although the Act mentions only these three instruments (such as a promissory note, a bill of exchange and cheque), it does not exclude the possibility of adding any other instrument which satisfies the following two conditions of negotiability: a) the instrument should be freely transferable (by delivery or by endorsement. and delivery) by the custom of t he trade; and b) the person who obtains it in good faith and for value should get it free from all defects, and be entitled to recover the money of the instrument in his own name.A negotiable instrument is a document which includes a promise to pay a set sum of money to the bearer of the document either on demand or on a given date. The instrument can be freely transferred without the need to notify the person from whom it originated. Negotiable instruments are used to enable trade, because without them, people would be obliged to exchange money in person for all sorts of transactions, and this would quickly become unsafe in addition to unwieldy.One simple example of a negotiable instrument is a check. A check is written out to the bearer for a specific amount. The bearer can take the check to a bank and deposit it, thereby transferring the obligation to the bank. The bearer can also sign the check over to someone else, another example of a transfer. Checks also demonstrate another important property of negotiable instruments, which is that people need to have them in hand to redeem or negotiate them. If the document is lost, it cannot be called upon.As such, documents like share warrants payable to bearer, debentures payable to bearer and dividend warrants are negotiable instruments. But the money orders and postal orders, deposit receipts, share certificates, bill of lading, dock warrant, etc. are not negotiable instruments. Although they are transferable by delivery and endorsements, yet they are not able to give better title to the bona fide transferee for value than what the transferor has. 6 2. 2. Characteristics of a Negotiable Instrument A negotiable instrument has the following characteristics: ? Property:The possessor of the negotiable instrument is presumed to be the owner of the property contained therein. A negotiable instrument does not merely give possession of the instrument but right to property also. The property in a negotiable instrument ca n be transferred without any formality. In the case of bearer instrument, the property passes by mere delivery to the transferee. In the case of an order instrument, endorsement and delivery are required for the transfer of property. ? Title: The transferee of a negotiable instrument is known as ‘holder in due course. A bona fide transferee for value is not affected by any defect of title on the part of the transferor or of any of the previous holders of the instrument. ? Rights: The transferee of the negotiable instrument can sue in his own name, in case of dishonor. A negotiable instrument can be transferred any number of times till it is at maturity. The holder of the instrument need not give notice of transfer to the party liable on the instrument to pay. ? Presumptions: Certain presumptions apply to all negotiable instruments e. g. , a presumption that consideration has been paid under it.It is not necessary to write in a promissory note the words ‘for value receive d’ or similar expressions because the payment of consideration is presumed. The words are usually included to create additional evidence of consideration. ? Prompt Payment: A negotiable instrument enables the holder to expect prompt payment because a dishonor means the ruin of the credit of all persons who are parties to the instrument. 7 2. 3. The Nature and Purpose of Negotiable Instruments Negotiable instruments represent one form of property rights, i. e. exercised over incorporeal things â€Å"chose in action. † In other words, they are property rights in relation to objects of property which do not have physical or material existence and hence which cannot be perceived by the senses. A right of action under contract is a class of property known as ‘chose in action’ and can be distinguished from a corporeal movable property/ a ‘chose in possession’ which represent property rights exercised in relation to objects which have material or phy sical existence and hence can be perceived by the senses such as a book, a table or a watch.A holder of this type of property right must have actual possession of the object to exercise rights arising there from. Rights incorporated in negotiable instruments, rights of an inventor arising out of a grant of a patent in respect of his invention, rights of a copyrights holder, and rights of a trader in respect of his trademark, trade name and goodwill are instances of chose in action. Negotiable instruments also represent one kind of contract as every instrument embodies a contract or promise to pay a certain amount of money or to deliver goods according to terms agreed up on.As contracts, the general rules of contract shall apply unless they are specifically excluded from application by the special law applicable to negotiable instruments. As a result, the requirements necessary for the formation of a valid contract must be fulfilled for issuance of a valid and enforceable negotiable instrument. Hence, the parties who sign a negotiable instrument must have capacity under the law to enter into juridical acts, i. e. , minors and judicially interdicted persons may not create a valid contract through negotiable instruments.Furthermore, as a contract, any declaration or promise made on negotiable instruments must be accompanied by the signature of the person bound by such declaration or promise. Failure to comply with the requirements as to capacity and signature may be raised as a defense against any person who claims based on the instrument even against the holder in due course who, under other cases, is considered to be free from defenses available against the person who transferred the instrument to him. The parties must give their consent, which must be free from defects such as mistake, fraud, duress.The object of the contract must also be legal and possible. Where the contract does not fulfill requirements as to consent and object, a party affected may raise i t as a defense to avoid the contract and liability under the instrument. However, because of the special nature of these instruments, such defenses cannot be raised against a person, who acquires the instrument following the rules of transfer applicable to the instrument, and in good faith. 8 The main purpose of negotiable instruments is facilitation of commercial transactions.Commercial instruments are substitutes for money and are used as means of performance of money obligations. Dealing with them reduces the risk of loss or theft and the ease with which they can be transferred creates convenience which will in turn facilitate business. Transferable securities have the purpose of raising capital in the form of contributions made by purchase of shares and bonds, which is used for starting new businesses or expansion of existing businesses thereby increasing the production of goods and services in the country.A document of title to goods, whose negotiation transfers the goods repre sented by them, creates convenience and facilitates transactions involving the goods. For instance, a person selling warehoused goods can do so by endorsing and transferring the certificate of deposit and without the need to actually deliver the objects. When we come to the specific purposes of commercial instruments, promissory notes can be used as means of borrowing money, buying goods and services on credit and as method of evidencing a pre-existing debt.Certificates of deposit can be used as a device for encouraging individuals to deposit funds in banks; in return the holder of the certificate has the right to receive interest. Bills of exchange on the other hand have the purpose of collecting accounts financing, the movement of goods, and transfer funds. Checks serve as â€Å"vehicles for transfer of money and also used to aid in keeping records, reduces the risk of loss and destruction and theft of currencies. † 9 2. 4.Types of Negotiable Instrument Section 13 of the Ne gotiable Instruments Act states that a negotiable instrument is a promissory note, bill of exchange or a cheque payable either to order or to bearer. Negotiable instruments recognized by statute are: (i) Promissory notes (ii) Bills of exchange (iii) Cheques. Negotiable instruments recognized by usage or custom are: (i) Hundis (ii) Share warrants (iii) Dividend warrants (iv) Bankers draft (v) Circular notes (vi) Bearer debentures (vii) Debentures of Bombay Port Trust (viii) Railway receipts (ix) Delivery orders. 2. 4. 1.Promissory Notes Section 4 of the Act defines, â€Å"A promissory note is an instrument in writing (note being a bank-note or a currency note) containing an unconditional undertaking, signed by the maker, to pay a certain sum of money to or to the order of a certain person, or to the bearer of the instruments. † Essential elements: 1. It must be in writing 2. It must certainly an express promise or clear understanding to pay 3. Promise to pay must be unconditio nal 4. It should be signed by the maker 5. The maker must be certain 6. The payee must be certain 7. The promise should be to pay money and money only 8.The amount should be certain; and 9. Other formalities regarding number, place, date, consideration etc. 10 2. 4. 2. Bill of Exchange Section 5 of the Act defines, â€Å"A bill of exchange is an instrument in writing containing an unconditional order, signed by the maker, directing a certain person to pay a certain sum of money only to, or to the order of a certain person or to the bearer of the instrument†. A bill of exchange, therefore, is a written acknowledgement of the debt, written by the creditor and accepted by the debtor. There are usually three parties to a bill of exchange drawer, acceptor or drawer and payee.Drawer himself may be the payee. Essential conditions of a bill of exchange: 1. It must be in writing. 2. It must be signed by the drawer. 3. The drawer, drawee and payee must be certain. 4. The sum payable mu st also be certain. 5. It should be properly stamped. 6. It must contain an express order to pay money and money alone. 7. The order must be unconditional. Bills can be classified as: ? Inland and foreign bills. ? Time and demand bills. ? Trade and accommodation bills. 2. 4. 3. Cheques Section 6 of the Act defines â€Å"A cheque is a bill of exchange drawn on a specified banker, and not expressed to be payable otherwise than on demand†.A cheque is bill of exchange with two more qualifications, namely, (i) it is always drawn on a specified banker, and (ii) it is always payable on demand. Consequently, all cheques are bill of exchange, but all bills are not cheque. A cheque must satisfy all the requirements of a bill of exchange; that is, it must be signed by the drawer, and must contain an unconditional order on a specified banker to pay a certain sum of money to or to the order of a certain person or to the bearer of the cheque. It is essential that a bill of exchange must be accepted before its payment can be claimed a cheque does not require any such acceptance. . A cheque can only be drawn payable on demand, a bill may be also drawn payable on demand, or on the expiry of a certain period after date or sight. 4. A grace of three days is allowed in the case of time bills while no grace is given in the case of a cheque. 5. The drawer of the bill is discharged from his liability, if it is not presented for payment, but the drawer of a cheque is discharged only if he suffers any damage by delay in presenting the cheque for payment. 6. Notice of dishonor of a bill is necessary, but no such notice is necessary in the case of cheque. . A cheque may be crossed, but not needed in the case of bill. 8. A bill of exchange must be properly stamped, while a cheque does not require any stamp. 9. A cheque drawn to bearer payable on demand shall be valid but a bill payable on demand can never be drawn to bearer. 10. Unlike cheques, the payment of a bill cannot be countermanded by the drawer. 12 2. 4. 4. Hundis A â€Å"Hundi† is a negotiable instrument written in an oriental language. The term hundi includes all indigenous negotiable instruments whether they be in the form of notes or bills.The word ‘hundi’ is said to be derived from the Sanskrit word ‘hundi’, which means â€Å"to collect†. They are quite popular among the Indian merchants from very old days. They are used to finance trade and commerce and provide a fascicle and sound medium of currency and credit. Hundis are governed by the custom and usage of the locality in which they are intended to be used and not by the provision of the Negotiable Instruments Act. In case there is no customary rule known as to a certain point, the court may apply the provisions of the Negotiable Instruments Act.It is also open to the parties to expressly exclude the applicability of any custom relating to hundis by agreement (lndur Chandra vs. Lachhmi Bibi, 7 B. Endorsement The word ‘endorsement’ in its literal sense means, writing on the back of an instrument. But under the Negotiable Instruments Act it means, the writing of one’s name on the back of the instrument or any paper attached to it with the intention of transferring the rights therein.Thus, endorsement is signing a negotiable instrument for the purpose of negotiation. The person who effects an endorsement is called an ‘endorser’, and the person to whom negotiable instrument is transferred by endorsement is called the ‘endorsee’. Essentials of a valid endorsement: The following are the essentials of a valid endorsement: 1. It must be on the instrument. The endorsement may be on the back or face of the instrument and if no space is left on the instrument, it may be made on a separate paper attached to it called allonage. It should usually be in ink. 2.It must be made by the maker or holder of the instrument. A stranger cannot endorse it. 3. It must be signed by the endorser. Full name is not essential. 4. It may be made either by the endorser merely signing his name on the instrument (it is a blank endorsement) or by any words showing an intention to endorse or transfer the instrument to a specified person (it is an endorsement in full). 5. It must be completed by delivery of the instrument. The delivery must be made by the en dorser himself or by somebody on his behalf with the intention of passing property therein. 6.It must be an endorsement of the entire bill. A partial endorsement i. e. which purports to transfer to the endorse a part only of the amount payable does not operate as a valid endorsement. If delivery is conditional, endorsement is not complete until the condition is fulfilled. 14 The payee of an instrument is the rightful person to make the first endorsement. Thereafter the instrument may be endorsed by any person who has become the holder of the instrument. The maker or the drawer cannot endorse the instrument but if any of them has become the holder thereof he may endorse the instrument (Sec. 51).The maker or drawer cannot endorse or negotiate an instrument unless he is in lawful possession of instrument or is the holder there of. A payee or indorsee cannot endorse or negotiate unless he is the holder there of. 2. 8. Dishonor of a Negotiable Instrument When a negotiable instrument is d ishonored, the holder must give a notice of dishonor to all the previous parties in order to make them liable. A negotiable instrument can be dishonored either by non-acceptance or by non-payment. A cheque and a promissory note can only be dishonored by non-payment but a bill of exchange can be dishonored either by nonacceptance or by non-payment. . 8. 1. Dishonor by non-acceptance (Section 91) A bill of exchange can be dishonored by non-acceptance in the following ways: 1. If a bill is presented to the drawee for acceptance and he does not accept it within 48 hours from the time of presentment for acceptance. When there are several drawees even if one of them makes a default in acceptance, the bill is deemed to be dishonored unless these several drawees are partners. 2. When the drawee is a fictitious person or if he cannot be traced after reasonable search. 3.When the drawee is incompetent to contract, the bill is treated as dishonored. 4. When a bill is accepted with a qualified acceptance, the holder may treat the bill of exchange having been dishonored. 5. When the drawee has either become insolvent or is dead. 6. When presentment for acceptance is excused and the bill is not accepted. 15 2. 8. 2. Dishonor by non-payment (Section 92) A bill after being accepted has got to be presented for payment on the date of its maturity. If the acceptor fails to make payment when it is due, the bill is dishonored by nonpayment.In the case of a promissory note if the maker fails to make payment on the due date the note is dishonored by non-payment. A cheque is dishonored by non-payment as soon as a banker refuses to pay. An instrument is also dishonored by non-payment when presentment for payment is excused and the instrument when overdue remains unpaid (Sec 76). 2. 9. Working Definitions ? Negotiable means transferable. The negotiation that goes on refers to the transfer of the instrument between two people, or from one bank to another, or even from one country to ano ther. In the broadest sense, almost any agreed-upon medium of exchange could be considered a negotiable instrument. In day-to-day banking, a negotiable instrument usually refers to checks, drafts, bills of exchange, and some types of promissory notes. ? Because it is cheaper to use and easy to find than having to carry out the research again. Limitations of the Data Collection Every study, no matter how well it is conducted has some limitations. When making this assignment, there were also some unavoidable limitations.First, because of the limited time limit, this study was conducted only on a small amount of data. Findings In this study I have found a lot of essential knowledge about Negotiable Instruments that are used in banking sectors. Some of them are given below? The instruments should be freely transferable.An instrument cannot be negotiable unless it is such and in such state that the true owner could transfer by simple delivery or endorsement and delivery. ? Negotiability involves two elements namely, transferability free from e quities and transferability by delivery or endorsement. ? The holder of the instrument is presumed to be the owner of the property contained in it. ? ? All Negotiable Instruments are freely transferable. The instrument is transferable till maturity and in case of cheques till it becomes stale (on the expiry of 6 months from the date of issue). Certain equal presumptions are applicable to all negotiable instruments unless the contrary is proved. ? Finally, every negotiable instrument was made or drawn for consideration irrespective of the consideration mentioned in the instrument or not. 20 Fifth chapter: Conclusion 21 5. 1.
